This application is not targeted or intended for use by anyone under age 21. If under 21, the User must use the application under the supervision of a parent or legal guardian who agrees to be bound by these terms.

The user agrees that he/she is not listed on any U.S. government list of prohibited or restricted parties or regulations.

COPYRIGHT & TRADEMARKS

Unless otherwise indicated, the Application and all of its content such as logos, designs, text, and other materials without limitation are the property of Core Project Management Essentials. The PM Teacher application including its logo and designs are registered trademarks of Core Project Management Essentials and may not be copied, imitated, or used in whole or in part, without the prior written permission of Core Project Management Essentials. Other trademarks used in connection to this Application are the trademarks of their respective owners.

INDEMNIFICATION

This application is being offered AS-IS  and the User acknowledges that he or she is using this application at their own risk. However, Core Project Management is claiming that this application is merchantable, reliable, accurate, and fit for its purpose. We claim that this application is free of defects or viruses and able to operate on uninterrupted bases.
In the event of any continuous or major failure of the Application, the User may notify Core Project Management Essentials. Core Project Management Essentials will refund the purchase price of the Application to the User. Core Project Management Essentials will not have any other warranty obligation whatsoever for the use and any other claims losses, liabilities, damages, costs, or expenses attributable to any failure or association with this Application.

The User agrees to defend, indemnify and hold harmless Core Project Management Essentials and other affiliated companies, independent contractors, service providers and respective employees from any and all claims, suits, damages, costs, lawsuits, fines, penalties, liabilities, and expenses that may arise from or related to the user’s use or misuse of this Application

Any dispute or claim arising out of or relating to these Terms or use of the Application or any subsidiary, parent or affiliate company will be resolved by arbitration or qualifying small claims hearings.

FILING A CLAIM

For all disputes, the User must first send a written description of his or her claim to our Customer Service department to allow us an opportunity to resolve the complaint. Each party agrees to negotiate the claim in good faith. If Core Project Management Essentials and User are unable to agree on Core Project Management Essentials proposed resolution, the User may request arbitration within 30 days of receipt of the proposed decision. Core Project Management Essentials and User agree to split the cost for arbitration and pay for their own attorney fees and associated costs for filing, witnesses, evidence, preparation, presentation or other related expenses.

In the event of any long term continuous or major failure of the Application, the User may notify Core Project Management Essentials. Core Project Management Essentials will refund the purchase price of the Application to the User. Core Project Management Essentials will not have any other warranty obligation whatsoever for the use and any other claims losses, liabilities, damages, costs, or expenses attributable to any failure or association with this Application.

Core Project Management Essentials reserves the right without notice to deactivate, terminate, and or block any Users account to prevent future use of the application.
